The news for H-1Bs and L-1s keeps getting worse and worse for people born in India. The latest visa bulletin to come out of Washington, D.C. for September 2018 pushes back the final action dates for employment-based preference cases by years. Hopefully, this is a temporary blip and the action dates will revert to where they were in August.

Meanwhile, many H-1Bs and L-1s are considering Canada as an alternative. Unlike the U.S., Canada does not require permanent residence (PR) applicants to have a job offer or sponsorship by a close relative.
The most popular Canadian immigration program, the express entry federal skilled worker program, evaluates applicants on successful integration attributes such as age, level of education, work experience, facility with English or French, and connections to Canada.
Applicants can complete and submit their own application for permanent residence, hire an illegal representative, or hire a regulated Canadian immigration consultant or lawyer to help them obtain Canadian PR.
What many applicants do not realize is that being eligible for the Canadian Express Entry program does not equate to obtaining Canadian PR. Thousands of people apply for Express Entry Federal Skilled Worker permanent residence but only 4% of applicants who are ‘active’ in Express Entry are selected each time for PR.
